Returns & Refunds

This Returns & Refunds Policy governs returns, refunds and the exercise of the right of withdrawal for purchases made on mad56.it, in accordance with the Italian Consumer Code (Legislative Decree no. 206 of 6 September 2005, as amended). It applies only to “consumers”, i.e. natural persons acting for purposes outside any business, commercial or professional activity. This English version is a translation provided for convenience; the Italian version prevails. Last updated: June 2026.

1. Seller

The seller is Mad56 di Massimo Dante (sole proprietorship), registered office at Località alla sega, 1, 38068 Rovereto (TN) – e-mail [email protected].

2. Right of withdrawal (14 days)

For distance purchases, the consumer has the right to withdraw from the contract, without giving any reason and without penalty, within 14 days of the day on which they acquire physical possession of the goods (or, where several goods ordered in a single order are delivered separately, of the last item), pursuant to Articles 52-57 of the Italian Consumer Code.

To exercise the right of withdrawal, the consumer must inform the seller, before the deadline expires, by means of an explicit statement sent to [email protected], indicating the order details and the intention to withdraw. The consumer may, but is not required to, use the model withdrawal form set out in Annex I, Part B, of the Consumer Code. The burden of proof regarding the exercise of withdrawal within the deadline lies with the consumer.

3. Exclusions from the right of withdrawal

Pursuant to Art. 59 of the Consumer Code, the right of withdrawal is excluded, among other cases, for the supply of goods made to measure or clearly personalised. Accordingly, the following are excluded from withdrawal:

  • helmets and products made or personalised at the customer’s request, including graphics, paintwork and decorations carried out to measure (for example the “Paint your helmet” personalisation service), as personalised and non-resalable goods;
  • sealed goods which are not suitable for return for health-protection or hygiene reasons and which have been opened after delivery;
  • the further cases provided for by Art. 59 of the Consumer Code.

For standard, non-personalised products (for example accessories and catalogue items resold as such), the right of withdrawal applies in full as described in section 2.

4. Return of the goods

In the event of a valid withdrawal, the consumer must return the goods without undue delay and in any case within 14 days of communicating the withdrawal. The goods must be returned intact, unused, complete with every part and accessory and in their original packaging. The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning (Art. 57, paragraph 2).

5. Return costs

The direct costs of returning the goods are borne by the consumer, unless otherwise agreed in writing with the seller. We recommend keeping proof of shipment.

6. Refund

The seller will refund all payments received, including standard delivery costs, without undue delay and in any case within 14 days of being informed of the withdrawal. The refund will be made using the same means of payment used for the purchase, unless otherwise agreed and in any case at no cost to the consumer. The seller may withhold the refund until the goods have been received or until the consumer provides evidence of having sent them back, whichever occurs first (Art. 56, paragraph 3). Any additional costs arising from the choice of a delivery method other than the standard one offered by the seller will not be refunded.

7. Defective goods and the legal guarantee of conformity

Regardless of the right of withdrawal, and also for personalised products, the consumer is entitled to the legal guarantee of conformity of 24 months from delivery of the goods (Articles 128 et seq. of the Consumer Code). In the event of a lack of conformity, the consumer is entitled, at no cost, to have conformity restored through repair or replacement and, on a subsidiary basis, to a proportionate price reduction or to termination of the contract, in the cases provided for by law.

8. How to make a return — procedure

  1. Send a request to [email protected] within the applicable deadline, stating the order number and the reason (withdrawal or defect).
  2. Wait for confirmation and operating instructions from the seller.
  3. Ship the goods, suitably packaged, to the address provided, keeping the shipping receipt.
  4. Receive the refund or the replacement/repair as provided for in this policy.

9. Complaints and dispute resolution

For any complaint, you may write to [email protected]: the seller undertakes to respond as soon as possible. The consumer may also turn to the alternative dispute resolution (ADR/conciliation) bodies competent under Part V, Title II-bis, of the Consumer Code, without prejudice to the right to bring the matter before the competent court (the court of the consumer’s place of residence or domicile).

10. Changes to this policy

The seller may update this Returns & Refunds Policy to reflect regulatory or organisational changes. The current version is always published on this page, with the date of last update. Each sale is governed by the version in force at the time the order is submitted.
